Judge Dismissed the Case. But Still Called Him Guilty.

What you need to know: David Moerschel has been completely freed! But, his trial Judge, Amit Mehta, included an unconstitutional "Guilt Dicta" in the dismissal order. It is a statement of guilt that could be used against him later. The defense attorneys are asking the court to force the Judge to remove that section in his order to dismiss the case.

I'M FREE!: No kidding. Judge Dismissed My Case

I am at peak gratitude right now for being set free from an insane nightmare. My trial Judge, Amit Mehta, signed the final dismissal order on Tuesday, August 4, 2026. That put an end to 5 and a half years of persecution and political imprisonment.

I'm Free, But the Struggle Rages Around Me

What you need to know: On August 4, 2026, I went free! But the Judge included language in the dismissal could put me in legal jeopardy later. Do we appeal the unnecessary declarations of guilt the Judge used? It wouldn't touch the dismissal itself, just the inflammatory language the Judge used. We are seriously considering joining co-defendant Ed Vallejo in the appeal of this language.

Better Luck Next Week? - Judge Still Hasn't Freed Me

Was it too much to hope to be free this week? Maybe so. They are not done beating up on me. The DOJ submitted to the judge their "list of reasons" they were asking for my case to be dismissed. It seemed like the judge in my case was acting on a one week time table. So I expected him to sign off on dismissing my case this past Friday. But...he didn't.

Maybe 1 More Week Until I'm Free!

On Thursday, June 18 2026, the DOJ submitted a detailed motion listing the reasons why my case should be dismissed. The Appeal court dismissed my convictions and sent the case back to my trial Judge. The Judge did not immediately grant the motion, but he requested the DOJ submit a detailed list of reasons why he should dismiss the case.

I'm Not Free Yet - Comprehensive Update

I wish I could say this was over, but I am still a functional prisoner of the U.S. Government. Perhaps it would be more accurate to say I am a prisoner of the Judicial process now. Some of our supporters think I was pardoned, but I have not been pardoned.

Judge Blocking Dismissal of My Case!

When the DOJ filed with the Appeals court to dismiss my convictions, the Democrats were full force against me. In spite of these attacks, the Appeals Court granted the DOJ's motion and vacated my convictions on May 21,2026. But now the Judge at the District Court level is blocking my dismissal! He ordered the DOJ to explain WHY they thought my case should be dismissed. They did it to General Flynn too.

Still Fending Off U.S. Rep. Raskin's Attacks

Did you see that the DOJ has moved to dismiss my charges? Wonderful right? It should be. But Rep. Jamie Raskin filed a motion with the Appeals Court opposing it. On April 23, 2026, our attorneys filed an opposition to Jamie Raskin. On May 6, 2026, my appeal attorney sent me an email with (kinda, maybe) good news. Check it out.

NO PARDON FOR ME - It's Better!

I have good news and I have bad news. The bad news first: It does not look like I will get a pardon. Now the good news: It looks like I will get something BETTER than a pardon! Click the link the read about the DOJ filing a motion to dismiss my convictions.

Democrats Try To BLOCK Dismissing My Case!

My appeals attorney just called to tell me that Jamie Raskin (Rep, Dem) is trying to subvert the legal process of having my case dismissed! He is trying to file a brief with the Appeals Court to basically appoint a lawyer as a 3rd party to oppose the dismissal of my case and the other Proud Boys and Oath Keepers.
