To catch you up on my status:
- I am not pardoned. Even better...
- My convictions have been erased by the Appeals Court.
- My case was sent back to my trial judge to be dismissed.
- My trial judge asked the DOJ for a list of reasons why my case should be dismissed. (He wasn't going to let me off easy.)
- The government responded last Thursday to the Judge's order for a "statement of reasons" why my case should be dismissed.
- The ball is entirely in the judge's court now.
- I expected my trial judge to dismiss my case, as ordered by the Appeals Court, this week. But he didn't.
Better Luck Next Week?
Was it too much to hope to be free this week? Maybe so. They are not done beating up on me. The DOJ submitted to the judge their "list of reasons" why they were asking for my case to be dismissed. So I expected him to sign off on dismissing my case this past Friday. But...he didn't

They Did It To Flynn. They're Doing It To Me.
This is a classic playbook. They did the exact same thing to General Michael Flynn. It took 7 months from the time the DOJ moved to dismiss his case to the time when Judge Sullivan actually signed off on the dismissal. The DOJ moved to dismiss my case in April 2026. Here it is 2 1/2 months later, and we are still waiting. The ball is entirely in the judge's court.
